Terms of Use of Yango Drive

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING YANGO DRIVE.

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of Yango Drive Trading LLC (hereinafter referred to as Company or Yango Drive) to an Internet user (hereinafter referred to as the User) to use Yango Drive service (hereinafter referred to as the Service or Yango Drive) in United Arab Emirates.

1.2. The use of the Service by the User is governed by these Terms.

1.3. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions, in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms, the User may not use the Service.

1.4. Yango Drive enables the User to place information on the User’s potential demand for car rental services, look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms. Yango Drive is available via the website drive.yango.com (the “Website”).

YOU ACKNOWLEDGE THAT COMPANY DOES NOT PROVIDE CAR RENTAL SERVICES, TRANSPORTATION SERVICES OR FUNCTION AS A CARRIER AND THAT ALL SUCH SERVICES ARE PROVIDED BY THIRD PARTY – CAR RENTAL PROVIDERS, WHO ARE NOT EMPLOYED BY COMPANY OR ANY OF ITS AFFILIATES. THE RELATIONS BETWEEN YOU AND CAR RENTAL PROVIDERS ON THE ACQUISITION OF SERVICES ARE REGULATED BY RELEVANT AGREEMENTS BETWEEN YOU AND CAR RENTAL PROVIDER, COMPANY IS NOT THE PARTY OF THESE AGREEMENTS.

1.5. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to the Company.

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. Information on car rental services is provided by third parties (partners) – car rental providers. Information about the partners is available at the Website. For more information about the services offered, the User may contact the partners of the Service – car rental providers or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide them with information about car rental services offered.

2.3. Company shall not be held liable for the content and/or relevance of information provided by the partners of the Service – car rental providers, including information on the cost and current availability of the car rental providers’ benefits. The User shall independently (without the participation of Company) discuss the acquisition of services with the car rental providers in accordance with the car rental providers’ rules on the provision of car rental services. Company shall not be held liable for financial and any other transactions effected by the User and the car rental providers and for any consequences of the acquisition of the car rental providers’ services by the User.

2.4. The User can get acquainted via the Website with the car rental provider’s offers. The User intended to rent a car from the car rental provider sends a request to the car rental provider via the Website. Requests can be sent only with the Personal Data. Then the car rental provider shall contact the User and confirm or cancel the reservation of the car. Any further interaction including mutual settlements takes place between the User and the car rental provider directly without any Yango Drive’s participation.

3. Personal Data

3.1. Yango Drive shall process personal data in accordance with the present Terms and the Law of the United Arab Emirates.

3.2. The functionality of the Service available to the User includes possibility of collecting and storage of the personal data. In such cases the car rental provider shall be deemed as the controller. Further processing shall be done by Yango Drive as processor on behalf of the car rental provider under the car rental provider’s instructions.

3.3. Purposes of data processing. Yango Drive processes User’s personal Data in order to fulfil its obligations according to the Terms and provide the Services. Yango Drive may also process some personal Data for the purposes compatible with the performance of the Terms, including: (1) to comply with applicable law, (2) to improve the Services, (3) to protect data subjects’ vital interests or the vital interests of a third party or (4) for reasons of public interest.

3.4. Duration of data processing. Yango Drive processes personal Data as long as it is necessary for the purposes specified above and, after this period, if such processing is required by applicable law.

3.5. Categories of personal data. Yango Drive processes the following User’s personal Data (if the User provide such data via the Website and the Services): full name, phone number, email.

3.6. Data subject rights. The User has the certain rights as the personal data subject in accordance with in accordance with the Law of the United Arab Emirates..

3.7. The car rental provider is responsible for providing the User with the information about the processing of User’s data and the ways how you can exercise and enforce these rights.

3.8. Data sharing. Yango Drive uses the resources, IT-infrastructure, cloud technology of its affiliates and contractors to provide the User with the Services. Yango Drive transfers personal Data to the mentioned parties using the appropriate safeguards to ensure personal Data integrity and confidentiality in accordance with applicable law..

3.9. Yango Drive shall not disclose personal Data to any third party except the cases where: 1) such information is disclosed to the Party’s officers and employees or agents or affiliates, or 2) such disclosure is required by law; or 3) such disclosure is required by the Terms or necessary to fulfil Parties’ obligations under the Agreement; or 4) the information has already been disclosed or made available in public domain.

4. Governing law and dispute resolution

4.1. These Terms of Use of Yango Drive arising out of or in connection with these Terms shall be governed by and construed in accordance with law of England and Wales.

4.2. Any disputes arising out or in connection with these Terms of Use of Yango Drive shall be decided by the Courts of the Dubai International Financial Centre.

5. Amendments to the Terms

5.1. This Terms may be unilaterally amended by the Company, at any time without notice to the User. User notification of the amendments introduced to the Terms of Use of Yango Drive posted at: https://drive.yango.com/en/legal/yango_drive_terms_of_use. The said amendments to the Terms shall come into effect from the date of their publication, unless otherwise specified in the relevant publication. The User bears a risk of failure to review a new version of the Terms. Any continued use of the Service after the Terms have been changed will qualify as the acceptance of the new version.

5.2. The User shall stop using the Service, if he or she disagrees with any amendments to these Terms Company made as prescribed by s. 5.1 hereof.

5.3. You agree that Yango Drive’s right to terminate these Terms of Use are not subject to obtaining any prior order of a court.
